If you think it can’t happen, you haven’t been paying attention.
In 2015, the Supreme Court ruled that gay marriage was a constitutional right. If Texans have learned one thing about Republicans in 2021, we learned that Texas Republicans don’t care about the American Constitution.
In 1973, the Supreme Court determined that access to abortion was a constitutional right. That didn’t matter to Texas Republicans, as they’ve banned access to abortions in the State of Texas this year.
And in the 1960s, the Supreme Court determined that we all have the constitutional right to vote. Yet, this year, Republicans in Texas took that right away from millions.
Last week, State Representative James White wrote a letter to Attorney General Ken Paxton about gay marriage in Texas since legislators never removed a state law from the books defining marriage between a man and a woman.
White asserted that legalized gay marriage shouldn’t be permitted in the Lone Star State because he feels state law trumps the SCOTUS ruling in Obergefell v Hodges.
The 87th Legislature set precedence.
By stripping Texans’ constitutional rights away this year for voting and women’s healthcare, Texas Republicans have become emboldened. They will continue to take away the rights of Texans for any previous Supreme Court decision with which the far-right disagrees.
The right to vote? Banned.
Next? Gay marriage.
After that? Only English will be taught in schools. Forced prayer in schools. Christianity will be made the official religion of Texas. And interracial marriages will be outlawed.
Don’t think it can happen?
It already is.
What else have legislators conveniently forgotten to take out of the books?
Texas lawmakers have never axed a statute making “homosexual conduct” a Class C misdemeanor.
The statute defines this as “deviate sexual intercourse with another individual of the same sex.” The Supreme Court also struck this law down. However, as with women’s healthcare and voting rights, this doesn’t matter to Republicans.
Leaving these laws on the books, even if unenforceable under the law, can hurt the LGBTQ community.
That was intentional.
We should all take the Texas GOP’s embrace of fascism seriously. They will single-handedly erase all progress America has made in the last 60-years. They have proven that nothing is off of the table. Our country is in the middle of a 4-alarm fire, and much of it is centered around Texas. But Democrats in the Senate are still debating the filibuster.
We all have to fight back.
Call 202-224-3121 and demand that the Senate reform or end the filibuster today! Call both Cornyn and Cruz, even though they’re against it. Make sure your voice is heard.
Get involved in any way you can. We outnumber them. In Texas, there are more of us. If we all turn out to the polls in 2022, we can end this.
You HAVE TO vote, but even that isn’t good enough. Talk to your non-voting friends and family, make sure they understand how important it is and what’s at stake. We can overcome them, but it’s going to take all of us.
